fixed a warning in ap_TopRuler.cpp
this involved getting rid of an unused variable
this leaves us with 3 warning in the c++ code on linux.

1 is bogus (the variable is actually used)
1 is real (the code to check that option is ifdef'd out)
1 is unclear (it seems that NrElements (a macro) returns a signed int, I
don't know if this could be fixed)

none of our other platform have informative build logs on tinderbox,
except windows which seems to be reporting an error. the freebsd
tinderbox build is still showing the warnings for objects only used in
asserts (remember that flamewar :-). so there might be other warnings,
but I can't find them.
